Design and Construction

The contract strategy adopted for the design and construction phase of the Project has the following related objectives:

The first, second and third of these objectives can best be achieved by seeking the largest practical sized contracts commensurate with both the nature of the work and the source of funding.

Given the nature of work involved and the time within which the project is to be completed the fourth and fifth objective are best achieved by adopting a "design and build" approach where the contractor is responsible for both the design and the construction.

The FIDIC Conditions of Contract for EPC/Turnkey Projects, First Edition 1999. (EPC Contract) was selected as the basis for the design and construct contracts. This standard contract was then modified to meet the specific requirements of the Client and the funding agency and to ensure a clear allocation of the risks involved.

The adoption of the "design and build" approach logically dictates a single, all encompassing contract and this eliminates all gaps in the contractual coverage and provides a clear allocation of responsibility.

However, the source of the funding and its timing required that the Project be split into at least two main parts. The first part is the Istanbul Strait Crossing and the second part is the Commuter Rail.

The Istanbul Strait Crossing, called Contract BC1, is to be awarded as a single contract. The contract includes provisions to reduce to the degree possible the interface problems inherent in having overlapping responsibility for design and construction.

The Commuter Rail Portion of the Project will be contracted as two different contracts. The first Contract (CR1) will include all civil works, track works, depots and work shops and the Electro-Mechanical Works from Halkali to Yedikule and from Sogutlucesme to Gebze, and the second Contract (CR2) will include the Rolling Stock.
